Polymex Terms and Conditions of Sale

1. Application
These Terms & Conditions of Sale (“Terms”) apply to all purchases of products supplied by POLYMEX (“Products”). By purchasing from POLYMEX, the purchaser agrees to be bound by these Terms.
2. Orders & Acceptance
All orders are subject to acceptance by POLYMEX. POLYMEX reserves the right to refuse or cancel any order at its discretion.
Product specifications, colours and finishes may vary due to manufacturing processes.
3. Additive Manufacturing Characteristics
Products are manufactured using additive manufacturing (3D printing).
The purchaser acknowledges that visible layer lines, surface texture, print artefacts and minor dimensional variation are inherent characteristics of the manufacturing process and do not constitute defects.
4. Design Intent & Suitability
Products are mechanical mounting aids and restraint systems only.
They are not:

Structural load-bearing components
-
Crash-rated restraint systems
-
Certified ADR or marine survey components
-
Engine-bay rated components (unless expressly stated)
The purchaser is solely responsible for determining suitability for their application.
5. Installation Responsibility
The purchaser assumes full responsibility for installation.
This includes:

Ensuring adequate substrate strength
-
Using appropriate torque
-
Preventing over-tightening of stainless steel fasteners
-
Compliance with relevant electrical and safety standards
POLYMEX accepts no liability for improper installation.
6. Risk & Title
Risk passes to the purchaser upon dispatch.
Title passes upon full payment.
7. Limitation of Liability
To the maximum extent permitted by law:

POLYMEX’s total aggregate liability is limited strictly to the purchase price of the Product.

POLYMEX shall not be liable for any indirect, incidental, special or consequential loss, including:

Damage to vehicles, vessels or property
-
Electrical failure or fire
-
Personal injury
-
Loss of profits or business
-
Labour, removal or reinstallation costs
-
Downtime
-
Where liability cannot be excluded under Australian Consumer Law, it is limited (at POLYMEX’s option) to repair, replacement or refund.
8. Indemnity
The purchaser indemnifies POLYMEX against all claims, losses, liabilities, damages and expenses arising from:

Improper installation
-
Modification or misuse
-
Use outside intended purpose
-
Failure of surrounding components
-
Non-compliance with regulations
This indemnity survives termination of sale.
9. Commercial Use
Where Products are used in commercial, industrial, fleet, mining, marine charter or competition applications, liability remains strictly limited to repair, replacement or refund of the Product only.
No liability is accepted for operational downtime or commercial losses.
10. Force Majeure
POLYMEX is not liable for failure to perform due to events beyond reasonable control.
11. Governing Law
These Terms are governed by the laws of Queensland, Australia.
